The legal complaint argues that the preparation of the product exceeds three and a half minutes.
In the United States, most microwaveable food items come with clear preparation instructions, including an estimated time for cooking. Kraft’s Velveeta Shells & Cheese microwaveable mac and cheese, for example, suggests a preparation time of three and a half minutes. However, a consumer in Florida finds this timing inadequate.

Amanda Ramirez, a resident of Florida, has filed a class-action lawsuit against Kraft Heinz Foods Company, claiming that Velveeta Shells & Cheese requires more than three and a half minutes for preparation, which she argues amounts to false advertising. Ramirez is seeking $5 million in damages for this issue.
Ramirez supports her case by pointing out that the microwave instructions suggest a cooking time of three and a half minutes. However, when considering the additional time needed for tasks like unpacking, adding water, and stirring, it becomes evident that the product cannot be ready within that timeframe.
The lawsuit alleges that the listed preparation time may be a tactic to justify a higher price for the product, and Ramirez is described as a consumer who, like many others, aims to make wise monetary decisions while grocery shopping.

Due to the discrepancy in time, Ramirez argues that she “overpaid for the product and would have made a different purchasing decision or paid less had she known the actual facts.”
On the other hand, Kraft has dismissed the lawsuit as baseless and unwarranted. A spokesperson from Kraft Heinz Foods Company stated to CNN, “We are aware of this frivolous lawsuit and will vigorously defend against the claims made in the complaint.”
